I was just at a Small Business Conference last week where an Employee Communication policy around social media was discussed at length in one of our workshops. An employment lawyer who was running the session, warned about a law called "protected concerted activity" which protects employee rights to discuss the work environment among themselves. So an employee can say something negative about the workplace, and be protected against firing by this law - even if there was a social media policy in place. If your social media policy is found to be in violation of this law, then it's not enforceable.
